First, a person can be convicted if he or she uses force or threatens to use force to cause death or serious bodily injury in order to engage in a sexual act with another person. A defendant can also be convicted of aggravated sexual abuse if he or she uses an intoxicating drug or substance to render a victim unconscious, and then engages in sexual conduct with the unconscious person. A violation of this section is punishable by a maximum penalty of life in prison. A person commits aggravated sexual abuse with children if the victim of the offense is under the age of 16, and the penalty is increased substantially to include a minimum mandatory 30 year prison sentence. The potential penalties facing anyone convicted of a Federal sex offense are extreme.
